How is overtime pay calculated?

According to Article 13 of the Interim Provisions on Wage Payment: After the employee has completed the labor quota or prescribed work tasks, if the employer arranges the employee to work outside the statutory standard working hours according to actual needs, the employer shall pay wages according to the following standards:

(1) If an employer arranges for a worker to work overtime beyond the statutory standard working hours, the employer shall pay the worker a wage not less than 150% of the worker's hourly wage standard stipulated in the labor contract;

(2) If an employer arranges workers to work on rest days in accordance with the law but fails to arrange compensatory rest days, the employer shall pay the workers wages at a rate not less than 200% of the workers' daily or hourly wage stipulated in the labor contract;

(3) If an employer arranges employees to work on statutory holidays in accordance with the law, the employer shall pay the employees wages at a rate not lower than 300% of the employee's daily or hourly wage standard stipulated in the labor contract.

For workers who are paid on a piece-rate basis, if the employer arranges for them to work overtime after completing their piece-rate quota, their wages should be paid in accordance with the above-mentioned principles at a rate not lower than 150%, 200% or 300% of their piece-rate unit price for their statutory working hours.
