zhejiang’s new marriage leave regulations were officially passed today.
on september 27, the "marriage leave regulations of zhejiang province" were voted and approved at the 12th meeting of the standing committee of the 14th provincial people's congress, which clarified that employees who register their marriage in accordance with the law will enjoy 13 days of marriage leave.
the "regulations" shall come into effect from the date of promulgation. in other words, this wave of benefits can be enjoyed immediately.
the previous marriage leave regulations implemented in zhejiang were the "notice on the issues of marriage and funeral leave and travel leave for state-owned enterprise employees" formulated by the former state labor administration and the ministry of finance in 1980. the document stipulated that marriage leave was 1 to 3 days.
however, with the development of economy and society, the "marriage radius" is getting wider and wider. the proportion of inter-city and inter-province marriages in zhejiang is about 1/6 and 1/9 respectively. the increase in out-of-town marriages makes short marriage leave no longer suitable for actual needs.
in recent years, calls for an appropriate extension of marriage leave have become increasingly louder, and many deputies to the national people's congress and members of the chinese people's political consultative conference have also put forward relevant suggestions and proposals.
the benefits brought by the "regulations" go far beyond the extension of marriage leave.
the "regulations" clarify that national statutory holidays and rest days will not be counted as marriage leave, and wages, bonuses and other benefits for marriage leave will be paid as usual. if an employee chooses to take marriage leave, he or she must take marriage leave within one year from the date of registration of marriage. if the employee is unable to take marriage leave within one year due to work needs, the employer and employee may negotiate to postpone the marriage leave for half a year.
in terms of vacation methods, after consultation with the employer, employees can choose to take the vacation all at once or in installments, providing more flexible arrangements for both newcomers and employers.
newcomers who have just received their certificates don’t have to worry about missing out on this wave of benefits. according to the "regulations", if an employee has registered for marriage less than one year before the date of implementation of these regulations and has not taken marriage leave, these regulations shall apply; if an employee has taken marriage leave, he or she may make up for the marriage leave in accordance with these regulations.
employers should improve the internal management system for employees' marriage leave, protect employees' rights to take marriage leave, and implement employees' marriage leave and their benefits. if there is a violation of the regulations, the "regulations" clarify the penalties: if state agencies, public institutions and other employers managed with reference to the civil servant law fail to make corrections within the time limit, the responsible leaders and directly responsible persons will be punished in accordance with the law; if other employers refuse to make corrections or the circumstances are serious, they will be fined not less than 5,000 yuan but not more than 50,000 yuan.
as a piece of "little quick" legislation that "establishes what is lacking", the "regulations" fully embodies the reform concept of "legislating together". after the draft regulations were made public, 47 grassroots legislative contact points across the province conducted a questionnaire survey. the relevant webpages received a total of more than 18,000 hits and 11,300 comments on the website, many of which were incorporated.
