the ministry of commerce also stated that anti-dumping investigations are legitimate trade measures in line with wto rules to protect domestic industries. china's anti-dumping investigation on canola imports from canada is fundamentally different from the discriminatory measures taken by canada in violation of wto rules.
according to chinese law and wto rules, there are two situations in which anti-dumping investigations are initiated. one is to initiate an investigation upon application by the relevant industry; the other is to initiate an investigation independently by the investigation authority in accordance with its authority. due to the low concentration of china's rapeseed industry and the large number of growers involved, it is difficult for the industry to file an application. in this case, the chinese investigation authority independently initiates an investigation in accordance with the law on the basis of having sufficient evidence required for filing a case.
the investigation has just begun and is being conducted in accordance with legal procedures. the investigation authority will follow wto rules, conduct the investigation in an open and transparent manner, fully protect the rights of all stakeholders, and make a fair and impartial ruling based on the investigation results.
in the market, related commodity futures rose sharply. as of the close, the main contract of rapeseed oil futures turned positive and rose 0.07%, after having fallen by more than 2% before; the main contract of rapeseed meal futures fell 0.35%, after having fallen by more than 4% before.

article 18 of the anti-dumping regulations of the people's republic of china stipulates: "under special circumstances, if the ministry of commerce has not received a written application for an anti-dumping investigation, but there is sufficient evidence to believe that there is dumping and injury and that there is a causal relationship between the two, it may decide to initiate an investigation."
the preliminary evidence and information obtained by the ministry of commerce show that the imported rapeseed originating from canada is exported to china at a price lower than the normal value, which is dumping. at the same time, the quantity of this product entering the chinese market has increased significantly, and the price has continued to fall, which has reduced and suppressed the prices of similar products in china's domestic industry. china's domestic industry has suffered substantial damage. there is a causal relationship between the dumping of imported products from canada and the substantial damage to the domestic industry.
in accordance with article 18 of the anti-dumping regulations of the people's republic of china, the ministry of commerce has decided to initiate an anti-dumping investigation on imported rapeseed originating from canada from september 9, 2024. the relevant matters are hereby announced as follows:
i. investigation and investigation period
as of the date of this announcement, the ministry of commerce will initiate an anti-dumping investigation on imported rapeseed originating in canada. the dumping investigation period determined in this investigation is from january 1, 2023 to december 31, 2023, and the industry damage investigation period is from january 1, 2021 to december 31, 2023.
ii. products under investigation and scope of investigation
scope of investigation: imports of rapeseed originating in canada.
name of the product under investigation: rapeseed (called rapeseed in the customs import and export tariff of the people’s republic of china).
english name: rape or colza seeds.
product description: rapeseed is a small spherical seed of the cultivated rapeseed of the cruciferous herbaceous plant with long siliques. the seed coat is black, yellow, brown and red.
main uses: mainly used to produce rapeseed oil and rapeseed meal, etc.
this product is classified in the customs import and export tariff of the people's republic of china: 12051090, 12059090.
3. register to participate in the survey
the interested parties shall register with the trade remedy investigation bureau of the ministry of commerce to participate in this anti-dumping investigation within 20 days from the date of this announcement. the interested parties participating in the investigation shall provide basic identity information, the quantity and amount of the investigated products exported or imported to china, the quantity and amount of similar products produced and sold, and related information in accordance with the "reference format for registration to participate in the investigation". the "reference format for registration to participate in the investigation" can be downloaded from the trade remedy investigation bureau sub-website of the ministry of commerce website.
interested parties who register to participate in this anti-dumping investigation should submit an electronic version through the "trade remedy investigation information platform" (https://etrb.mofcom.gov.cn) and submit a written version at the same time according to the requirements of the ministry of commerce. the electronic version and the written version should have the same content and the same format.
the interested parties referred to in this announcement are the individuals and organizations specified in article 19 of the anti-dumping regulations of the people's republic of china.
iv. accessing public information
interested parties may download the case public information from the trade remedy investigation bureau sub-website of the ministry of commerce website or search, read, transcribe and copy the case public information in the trade remedy public information reading room of the ministry of commerce (tel: 0086-10-65197878).
v. comments on the case
if interested parties wish to comment on the product scope, investigated countries and other related issues of this investigation, they may submit written opinions to the trade remedy investigation bureau of the ministry of commerce within 20 days from the date of publication of this announcement.
vi. survey method
pursuant to article 20 of the anti-dumping regulations of the people's republic of china, the ministry of commerce may use questionnaires, sampling, hearings, on-site inspections and other methods to obtain information from relevant stakeholders and conduct investigations.
in order to obtain the information required for the investigation of this case, the ministry of commerce usually issues a questionnaire to the interested parties within 10 working days from the deadline for registration for the investigation as stipulated in this announcement. interested parties can download the questionnaire from the trade remedy investigation bureau sub-website of the ministry of commerce website.
the "questionnaire for foreign exporters or producers in the rapeseed anti-dumping case" asks for information including the company's structure and operation, the investigated products, export sales to china, domestic sales, business and financial related information, production costs and related expenses, estimated dumping margins and checklists, etc. the "questionnaire for domestic producers in the rapeseed anti-dumping case" asks for information including the basic situation of the producer, the situation of similar domestic products, business and related information, financial and related information, and other issues that need to be explained, etc. the "questionnaire for domestic importers in the rapeseed anti-dumping case" asks for information including the basic situation of the company, the investigated product trade and related information, etc.
interested parties should submit complete and accurate answers within the specified time, which should include all the information required by the questionnaire.
vii. submission and processing of information
when interested parties submit comments, questionnaires, etc. during the investigation process, they should submit an electronic version through the "trade remedy investigation information platform" (https://etrb.mofcom.gov.cn), and submit a written version at the same time according to the requirements of the ministry of commerce. the electronic version and the written version should have the same content and the same format.
if the information submitted by the interested party to the ministry of commerce needs to be kept confidential, the interested party may make a request to the ministry of commerce for confidential treatment of the relevant information and explain the reasons. if the ministry of commerce agrees to its request, the interested party applying for confidentiality shall also provide a non-confidential summary of the confidential information. the non-confidential summary shall contain sufficient and meaningful information so that other interested parties can have a reasonable understanding of the confidential information. if the non-confidential summary cannot be provided, the reason shall be explained. if the information submitted by the interested party does not state that it needs to be kept confidential, the ministry of commerce will regard the information as public information.
8. consequences of non-cooperation
according to article 21 of the anti-dumping regulations of the people's republic of china, when the ministry of commerce conducts an investigation, the interested parties shall truthfully reflect the situation and provide relevant information. if the interested parties fail to truthfully reflect the situation, provide relevant information, or fail to provide necessary information within a reasonable time, or seriously hinder the investigation in other ways, the ministry of commerce may make a ruling based on the facts already obtained and the best information available.
ix. investigation period
the investigation will begin on september 9, 2024 and should normally be completed before september 9, 2025. it may be extended by 6 months in special circumstances.
