According to the provisions of Article 14, Item 5 of the "Shanghai Implementation Measures for Work-related Injury Insurance", "if an employee is injured due to work reasons or is missing due to an accident during a work trip", it should be recognized as a work-related injury. Article 4 of the "Opinions on Several Issues Concerning the Implementation of the Work-related Injury Insurance Regulations (II)" of the Ministry of Human Resources and Social Security stipulates: "If an employee is injured in an accident while participating in an activity organized by the employer or assigned by the employer to participate in other activities, it should be regarded as a work-related injury, except for participating in activities unrelated to work." Article 4, Item 2 of the "Provisions of the Supreme People's Court on Several Issues Concerning the Trial of Administrative Cases on Work-related Injury Insurance" stipulates that "if an employee is injured while participating in an activity organized by the employer or assigned by the employer to participate in other activities, and is identified as a work-related injury by the social insurance administrative department, the people's court should support it.
Therefore, some experts pointed out that whether an employee's injury during a team-building activity organized by the unit is considered a work-related injury should be carefully considered from multiple aspects, such as the purpose of the activity, the cost of the activity, the content of the activity arrangement, and the composition of the participants, to determine whether it is related to work. "For example, cultural and sports activities organized or designated by the employer, as well as activities organized by the unit that require "participation through the unit's assignment, selection, and other procedures," can be regarded as work reasons, and employees injured in these team-building activities can be recognized as work injuries; however, if the employer arranges or organizes employees to participate in catering, sightseeing, leisure and entertainment activities in the name of work, or engages in activities involving leadership or personal interests, it is generally not recognized as "due to work reasons."
