overtime on october 1, 2 and 3:these three days are statutory holidays. if an employer arranges workers to work overtime on statutory holidays, they should pay them no less than their daily wages.300%compensatory leave cannot be used in lieu of overtime pay.

overtime on october 4, 5, 6 and 7:these four days are rest days. if an employer arranges workers to work on rest days and fails to arrange compensatory leave, the employer shall pay workers no less than the worker’s daily wage.200%of salary compensation.

👉calculation formula:
daily wage = monthly wage income ÷ number of payroll days per month (21.75 days)
monthly salary days = (365 days - 104 days) ÷ 12 months = 21.75 days
3 times daily wage = monthly wage ÷ 21.75 × 3
2 times daily wage = monthly wage ÷ 21.75 × 2

👉policy basis:

article 44 of the labor law of the people's republic of china states that in any of the following circumstances, the employer shall pay the employee wages higher than the employee's normal working hours wages in accordance with the following standards:

(1) if a worker is arranged to work overtime, he shall be paid wages not less than 150% of his wages;

(2) if workers are arranged to work on rest days and no compensatory rest days are arranged, they shall be paid wages not less than 200% of their wages;

(3) if workers are arranged to work on statutory holidays, they shall be paid wages not less than 300% of their wages.
