In terms of data storage and accident analysis, relevant intelligent connected vehicle companies should ensure that the vehicle's on-board equipment continuously and completely records and stores data such as the location, operating status, driving mode, and in-vehicle and out-of-vehicle surveillance videos before and after the vehicle accident or failure in accordance with regulations.The data storage period shall not be less than thirty days

How is liability determined when an accident occurs?

The Draft for Comments stipulates:

If an intelligent connected vehicle commits a road traffic safety violation and is equipped with a driver or a safety officer, the traffic management department of the public security organ may handle the driver or the safety officer in accordance with the law;

If the vehicle is not equipped with a driver or a safety officer, the traffic management department of the public security organ may take action against the vehicle pilot entity and the operating entity in accordance with the law.

If it can be determined that the traffic violation was caused by the autonomous driving system, the intelligent connected vehicle manufacturer, pilot entity, or operator will be dealt with in accordance with regulations.

Division of accident responsibility and compensation

The Draft for Comments stipulates

If an intelligent connected vehicle causes a traffic accident during road testing, demonstration application, or commercial operation, the traffic management department of the public security agency shall conduct an investigation and handle the matter in accordance with the relevant provisions of the road traffic safety laws and regulations, determine the responsibility for the traffic accident, and impose penalties on the parties in accordance with the law;

If a crime is constituted, the criminal liability of the parties involved shall be investigated in accordance with the law. If a traffic accident occurs during road testing, demonstration application and commercial operation of an intelligent connected vehicle and causes damage, and the intelligent connected vehicle is responsible, the vehicle pilot entity and the operating entity shall bear the compensation liability.

In addition, if damage is caused by defects in smart connected vehicles, the injured party can request the manufacturer or seller to bear the liability for compensation; or the vehicle pilot entity or operating entity can seek reimbursement from the manufacturer or seller in accordance with the law after compensation is made.
