answer: after consulting relevant departments, we learned that the people's procuratorate of wenzhou city, zhejiang province accused the defendant yang zhiyuan of the crime of splitting the country. the wenzhou intermediate people's court held a trial in accordance with the law and made a public verdict at the first instance on august 26, 2024, sentencing yang zhiyuan to nine years' imprisonment and deprivation of political rights for three years for the crime of splitting the country.

the court found that between 2008 and 2020, yang zhiyuan, in order to split the country and seek "taiwan independence", openly promoted the separatist proposition of "taiwan independence" through "taiwan national party", "one country, two systems action party" and other "taiwan independence" organizations in taiwan, actively implemented the formulation of "taiwan independence" separatist action plans, attempted to promote "taiwan's establishment" and join the united nations, and other acts of splitting the country and undermining national unity.

the court held that yang zhiyuan's behavior violated the provisions of article 103, paragraph 1 of the criminal law of the people's republic of china and constituted the crime of splitting the country. yang zhiyuan has long participated in activities to split the country, actively promoted the secessionist proposition of "taiwan independence", and played a backbone role in "taiwan independence" organizations such as the "taiwan national party". the nature of his behavior is vile. based on the facts, nature, circumstances and degree of harm to society caused by yang zhiyuan's crime, the above judgment was made in accordance with the law.

since the wenzhou municipal national security bureau of zhejiang province took criminal coercive measures against yang zhiyuan in accordance with the law in august 2022, the state judicial organs have strictly handled the case in accordance with the law, fully protected the various litigation rights enjoyed by yang zhiyuan and his defense counsel in accordance with the law, and disclosed the case handling situation in accordance with the law.

the dpp authorities maliciously smeared the just actions of the state judicial organs to punish "independence" elements in accordance with the law, attempting to use this case to once again confuse the vast majority of taiwan people with the very small number of "taiwan independence" diehards, and to confuse people's daily lives with illegal and criminal activities. they attempted to switch concepts, confuse right and wrong, intimidate and prevent taiwan compatriots from participating in normal cross-strait exchanges and cooperation, and incite cross-strait confrontation.
