Beijing proposes new regulations: Flexible employment personnel enjoy social security subsidies and should report employment status regularly

Beijing News (Reporter Ye Hongmei) Recently, the Beijing Municipal Human Resources and Social Security Bureau has drafted the "Beijing Flexible Employment Social Insurance Subsidy Personnel Identification and Review Measures (Trial) (Draft for Comments)" and solicited public opinions. The draft for comments stipulates the eligibility of flexible employment personnel to apply for social insurance subsidies, and proposes that flexible employment personnel should report at least once every three months during the period of enjoying social insurance subsidies, and should report changes in their work content in a timely manner.
According to the draft for soliciting opinions, people with difficulty in finding employment, college graduates who have not found a job within two years of leaving school, and registered unemployed family members who are accompanying the military in Beijing for the first time can apply for social insurance subsidies after finding flexible employment in the form of self-employment, part-time work, or new employment forms.
Flexible employment personnel who apply for social insurance subsidies must meet the following conditions: have achieved flexible employment and have completed personal employment registration for 30 days; obtain labor remuneration or business income through labor; and declare and pay social insurance premiums as flexible employment personnel.
When a person who receives social insurance subsidies for flexible employment establishes a labor relationship with an employer and signs a labor contract; stops flexible employment; the social insurance subsidy expires; reaches the statutory retirement age or receives basic pension insurance benefits, or falls into other circumstances stipulated by laws, administrative regulations and relevant documents that prohibit the enjoyment of social insurance subsidies, he or she will stop receiving the social insurance subsidies for flexible employment.
It is worth noting that the draft for comments also clarifies that flexible employment personnel who apply for social insurance subsidies should truthfully report their employment status. The employment status report of flexible employment personnel includes work location, working hours, work content and labor income, and provide corresponding supporting materials.
According to the draft for comments, flexible employment personnel should report at least once every three months during the period of enjoying social insurance subsidies, and should promptly report changes in their work content. Flexible employment personnel can report their employment status through the public employment service agencies of the subdistricts (townships) where they are employed or through the government website and official WeChat public account of the Beijing Municipal Human Resources and Social Security Bureau.
For those who fail to report their employment status on time as required, social insurance subsidies will be suspended. Flexible employment personnel can apply to the subdistrict (township) public employment service agency to resume social insurance subsidies and report their employment status. If they are verified to meet the conditions, they will be resumed from the month of application.
