After a round of confrontation between China and Thailand Red Bull, the debate and game is still going on.

On August 1, Huabin Group, the operator of China Red Bull, issued "China Red Bull's Response to Thai TCC's Official Statement on July 31", stating that Thai TCC Group's statement in response to the court's dismissal of all its lawsuits against China Red Bull's partners for trademark infringement did not make a positive response to the authenticity of the 50-year "Agreement" and China Red Bull's "exclusive operating rights" as determined in the Civil Judgment No. (2021) Xiang 01 Minchu 564 of the Changsha Intermediate People's Court (hereinafter referred to as "Changsha Intermediate Court"). Instead, it used procedural problems in the judgment and the intention to appeal as a cover-up for maliciously tearing up the contract and abusing the right to sue, and continued to confuse the public with the judgment No. (2020) Supreme People's Court Civil Final No. 394 (hereinafter referred to as the "Supreme Court Ownership Case") of the Supreme People's Court.

To this end, the Reignwood Group responded that the Supreme Court's ownership case was made under the premise that the original of the 50-year "Agreement" was not provided and its "authenticity was in doubt". In 2022, the Reignwood Group found the original of the 50-year "Agreement" and applied to the Supreme Court for a retrial based on this new evidence, and submitted it to the Qianhai District People's Court of Shenzhen City, Guangdong Province (hereinafter referred to as the "Qianhai Court"), which heard the 50-year contract validity case. On December 19, 2022, the Qianhai Court determined that Article 1 of the 50-year "Agreement" (i.e., the clause that "China Red Bull enjoys exclusive operating rights") is authentic, legal and valid; on August 31, 2023, the Supreme People's Court issued the Civil Ruling No. (2021) Supreme People's Court Civil Application No. 1162, which determined that China Red Bull enjoys a 50-year exclusive license to use the trademark and that Thai Tianshi has the obligation not to use the registered trademark.

"So far, the new evidence of the original 50-year-old "Agreement" has been successively recognized by the Qianhai Court and the Supreme Court, and the relevant recognition has changed the relevant facts recognized by the Supreme Court in the ownership case. This is also the background and factual basis for the judgment of the Changsha Intermediate People's Court (2021) Xiang 01 Minchu No. 564, which is reasonable and legal." Huabin Group pointed out in a statement.

In response to the latest statement released by the Reignwood Group, a reporter from Nandu Wancai asked for a response from the Thai Tianshi Group, but no clear reply was received as of press time.

It is worth noting that the latest statement of the Reignwood Group also mentioned more information, saying that after the Red Bull brand grew in China, the former CEO of China Red Bull and Thai Tianshi colluded internally and externally to register a new company to replace China Red Bull. "Thai Tianshi first threatened to cut off the supply of flavors and fragrances and stop using the trademark, maliciously hijacking and robbing the assets and market share of the joint venture. After achieving certain "results" through threats and false negotiations, it began to use judicial proceedings and behavioral preservation as tools, supplemented by exaggerated propaganda, intimidation and other ulterior means, attempting to "encircle and suppress" China Red Bull, commissioned processors, suppliers, and sellers in order to achieve the strategic goal of "picking peaches". "The Reignwood side finally made clear its determination, saying "resolutely fight and fight to the end."

It is not difficult to find that the information mentioned by Huabin Group this time, such as "the 50-year "Agreement" was recognized" and "the former CEO of China Red Bull and Thai Tianshi colluded internally and externally", all point to the focus of attention inside and outside the industry. How will Thai Tianshi Group "take the challenge"? Nandu Wancaishe reporters will continue to pay attention.
