a nearby vendor recalled the situation at the time, saying that they first heard a "bang" and then someone shouted "someone was hit." later, many people ran over and found two old ladies and an old man lying on the ground. at this time, someone called 120 and 110 to report the incident. ambulances and traffic police quickly arrived at the scene to provide treatment and investigate. "the driver who caused the accident was immediately controlled by the traffic police."

tongnan police said that after the incident that day, the command center received a report that a car had hit three pedestrians and the injuries were serious, so they immediately ordered the traffic police detachment to send traffic police to deal with the situation.

it is reported that after 120 arrived at the scene, it was confirmed that an old lady died on the spot, and the other two injured were sent to tongnan district people's hospital for treatment.

the chongqing emergency management bureau stated that the person who died on the spot was 79-year-old mrs. fan, and the injured ones who fell to the ground were her 82-year-old husband and 87-year-old old friend mrs. tang. at 3:10 a.m. on october 3, 2023, mrs. fan’s husband unfortunately passed away after failed rescue efforts. earlier on the day of the incident, at around 5:30 p.m., mrs. tang also unfortunately passed away in the tongnan district people’s hospital due to failed rescue efforts.

according to people familiar with the matter, the three of them were all local people in tongnan district. they had agreed to go out for a walk before the incident. unexpectedly, the unfortunate incident happened, which is extremely sad.

the appraisal report issued by the physical evidence appraisal institute of the tongnan district public security bureau confirmed that both mrs. fan and mrs. tang died of respiratory and circulatory failure caused by craniocerebral injury, and that mrs. fan's partner died of respiratory and circulatory failure caused by craniocerebral injury combined with traumatic shock.

the chongqing emergency management bureau said that according to relevant regulations, an accident investigation team was set up afterwards, led by the bureau and attended by personnel from the municipal public security bureau, municipal transportation bureau, tongnan district emergency management bureau and other units. at the same time, the tongnan district discipline inspection and supervision commission and the district procuratorate were invited to participate in the accident investigation.

according to the investigation, the driver li was driving a small new energy car with license plate number chongqing a along jianshe road in tongnan district from the former county fleet towards dafo middle school. when he reached the outside of the former maternal and child health hospital, he collided with three elderly people walking on the road in the same direction in front of him and a car with license plate number chongqing c parked in a roadside parking space, resulting in the traffic accident in which one old lady was killed on the spot, two elderly people were injured, and two cars were damaged.

the accident investigation team determined that this was a production safety responsibility accident, and on july 10, 2024, issued the "investigation report on the "10.2" major road traffic accident on jianshe road, dafo street, tongnan district, chongqing", stating that the accident caused direct economic losses of 1.064556 million yuan.

the online taxi driver involved in the accident had committed 20 traffic violations in the past three years, including many times failing to give way to pedestrians

investigations show that the driver, li, is from tongnan district, chongqing. he is also an online taxi driver for the chongqing branch of shenzhen wanshun taxi cloud information technology co., ltd. (hereinafter referred to as wanshun taxi chongqing company). the company was established on april 7, 2017, with its registered address at honghe avenue, yongchuan district, chongqing. the person in charge is surnamed liao, and the company has obtained an online taxi booking business license.

upon investigation, it was found that li first obtained a driver's license on july 29, 2002, and the permitted driving type was a2; on june 19, 2017, the permitted driving type was cancelled at the vehicle management office of the traffic police detachment of the public security bureau of beihai city, guangxi, and was downgraded from a2 to b1b2; on september 27, 2019, all full-score learning records were recorded at the vehicle management office, and the permitted driving type was changed from b1b2 to c1; on november 2, 2022, he transferred from guangxi to chongqing, and the permitted driving type was c1. li also obtained a driver's license for online taxi reservations.

the investigation revealed that in the past three years, li had committed 20 traffic violations, but all of them had been dealt with. among them, in wuxi, jiangsu from 2020 to 2021 and in tongnan, chongqing after 2022, his main violations were illegal parking 11 times, violating the prohibition sign twice, driving in the guide lane not in accordance with regulations twice, and failing to stop and yield to pedestrians crossing the crosswalk twice, in addition to speeding.

it is also reported that the byd sedan with license plate number yu a driven by li at the time of the incident was rented from a leasing company in tongnan district. in the past three years, the car has a total of 7 traffic violation records, including 1 illegal running of traffic lights and 1 speeding in 2022, 2 failure to give way to pedestrians and 2 illegal parking in 2023, and others, which had been dealt with before the incident.

investigations showed that starting at 6:04 a.m. on the day of the accident, online taxi driver li received orders through the wanshun taxi chongqing company platform and provided taxi booking services in tongnan city. after receiving the order at 2:42 p.m. that day, he drove passengers from tongnan district's waitan binjiang road to hongyang community, and then went to hongyang community via binjiang road, datong street, and jianshe road. when he arrived at the scene of the accident, the vehicle deviated from the straight lane and collided with three pedestrians.

after investigation, it was found that the car was traveling at a speed of 37km/h at the time of the accident, which ruled out the possibility that li was driving under the influence of alcohol or drugs.

the road traffic accident identification report issued by the traffic police department stated that li was distracted while driving and operated improperly, causing the vehicle to deviate from its normal driving trajectory, which was the direct cause of the accident.

the investigation found that wanshun taxi chongqing company failed to educate and urge online car-hailing drivers to strictly implement safety regulations and systems, failed to conduct pre-job education and training assessments for them in accordance with internal regulations, and did not conduct theoretical and road tests, and failed to ensure that online car-hailing driver li mastered the operating procedures and emergency measures for safe and civilized driving. at the same time, it was stated that the rental company failed to educate and urge drivers to strictly implement safety regulations and systems, failed to conduct pre-job safety education for driver li in accordance with the required study hours, failed to strictly implement the company's regular safety meeting system, and failed to educate and urge driver li to drive safely and civilized.

the investigation also found that the tongnan district transportation bureau did not carry out effective safety supervision and inspection measures, and did not implement law enforcement inspections and handle them in a standardized manner. the tongnan district public security bureau traffic police detachment did not carry out adequate inspections of potential road accident hazards in the area, and did not take corresponding inspection and control measures for potential accident hazards that affected vehicle driving due to illegal temporary parking spaces on accident sections.

the tongnan district urban management bureau failed to supervise and manage the temporary parking spaces for accidents, and did not conduct an assessment and adjustment of the temporary parking spaces on the accident road section. it also failed to remove or adjust the temporary parking spaces for accidents in a timely manner in accordance with the law, even though the parking spaces were obviously set up in violation of regulations.

the investigation team said that the driver li was directly responsible for the accident and was suspected of traffic accident. he was detained the day after the incident and arrested on october 16 of the same year.

at the same time, it was suggested that the chongqing municipal emergency management bureau impose an administrative penalty of 1.25 million yuan on wanshun taxi chongqing company. the general manager of the company, liao, was responsible for the accident and was fined 21,600 yuan by the chongqing municipal emergency management bureau. the rental company was also fined 1.2 million yuan, and its head was fined more than 20,000 yuan.

the investigation team said that the clues and related materials found in the accident investigation process regarding the performance of duties by relevant departments and public officials will be transferred to the tongnan district commission for discipline inspection and the yongchuan district commission for discipline inspection for accountability according to management authority. the commission for discipline inspection will propose party and government disciplinary sanctions for relevant personnel and the opinions on the handling of relevant units, and those suspected of criminal offenses will be transferred to judicial organs by the commission for discipline inspection and the supervision commission.
