On August 16, the Jinan Municipal Bureau of Justice issued an announcement soliciting opinions on the "Jinan Electric Bicycle Fire Safety Management Regulations (Draft for Comments)". The deadline for soliciting opinions is September 16, 2024.
In the draft for comments, the use of information and intelligent technologies is encouraged to promote the "one bike, one battery, one charger, one code" policy for electric bicycles, so as to realize digital management of electric bicycles such as information query and safety traceability.
According to the draft, the following acts are prohibited:
(1) Parking electric bicycles or charging electric bicycle batteries in public areas such as public foyers, stairwells, evacuation passages, emergency exits, corridors, walkways, etc. within a building;
(ii) Charging electric bicycles in indoor areas that are not centrally charged;
(3) Charging electric bicycles in underground garages and basements that do not meet fire safety requirements;
(iv) Violating the requirements for safe use of electricity by randomly pulling wires and sockets to charge electric bicycles;
(5) Carrying an electric bicycle or its battery into a passenger elevator or public transportation such as a bus or subway.
Any violation of the regulations will be subject to a fine ranging from 200 yuan to 50,000 yuan.
At the same time, if electric bicycles cause general or above fire accidents that result in death or have social impact, the responsible parties in various links such as production, sales, modification, parking, and charging will be traced and investigated across regions, and the relevant units and individuals will be held accountable in accordance with the law.
According to reports, this draft regulation has 22 articles, mainly focusing on the following aspects:
Establish and improve a safety supervision linkage mechanism. Fire safety supervision of electric bicycles is a full-chain work, involving multiple links such as production, sales, use, and recycling. It requires governments at all levels and relevant departments to fulfill their respective responsibilities and establish a normalized linkage mechanism. Article 4 stipulates the work responsibilities of municipal, district and county governments, town governments (street offices), and village (neighborhood) committees; Article 5 stipulates the work responsibilities of relevant departments.
Increase efforts to build parking and charging places. While strengthening the management of electric bicycles, promote the construction of parking places and charging facilities, optimize the layout of charging facilities, and promote the reduction of charging costs. Article 7 clarifies the construction requirements of centralized parking and charging places for electric bicycles in newly built public places, public buildings, residential communities and existing public places, public buildings, and residential communities; for those who are temporarily unable to build centralized parking and charging places for electric bicycles due to objective conditions, it is clearly stated that relatively independent safety areas can be demarcated in accordance with the law.
The management responsibilities of social entities should be tightened. The fire safety management of electric bicycles should not only rely on government departments, but also require the extensive participation of various social entities to strengthen self-management and self-governance. Article 8 stipulates the prohibited behaviors of parking and charging electric bicycles; Article 10 encourages the formulation of residential community management regulations, etc., to guide residents to do a good job in electric bicycle fire safety self-governance; Article 11 stipulates the management responsibilities that property service providers should perform.
Promote innovative measures to optimize management. Innovate and optimize relevant management measures, and while strengthening the management of electric bicycles, clarify the combination of education and punishment for illegal assembly and modification, illegal parking and charging, etc. Article 6 proposes to promote the "one vehicle, one battery, one charger, one code" for electric bicycles, and realize digital management of information query and traceability investigation; Article 10 encourages relevant units and individuals to purchase fire insurance; Article 15 proposes to improve the traceability investigation mechanism for electric bicycle fire accidents.
At present, there are about 4.6 million registered electric bicycles in Jinan. In addition, there are many vehicles that have not yet been licensed. The stock is large, the risks are high, and the management is difficult. The quality and safety of vehicles and batteries, illegal modifications, and insufficient parking facilities are prominent. It is urgent to pass local legislation to form a prevention and control mechanism from various links such as production, sales, recycling, parking, and charging, strengthen source management, clarify the supervision matters of various departments, consolidate the responsibilities of property and related companies, strengthen the autonomy of the people and the industry, and build a new pattern of co-construction, co-governance, and sharing. It will effectively reduce stock risks, strictly control incremental risks, and comprehensively improve the level of fire safety management of electric bicycles.
