regarding the recent online media reports that "a 5-year-old girl was killed by a vehicle while playing alone on the road in the community", our bureau attaches great importance to it and has conducted investigations in accordance with the law. the relevant situation is now reported as follows:

i. basic information of the case

at around 2 p.m. on april 5, 2024, zhang (male, 25 years old, from ziyang city, sichuan province) was driving a small car in a residential area in shuangliu district of the city when he knocked down a 5-year-old girl. the girl died after all efforts to rescue her at the hospital failed.

ii. regarding the litigation status of the case

on april 5, 2024, our bureau investigated and believed that zhang was suspected of the crime of negligent homicide and took compulsory measures of criminal detention against him. on april 19, the people's procuratorate of shuangliu district decided to approve the arrest of zhang on suspicion of the crime of negligent homicide. on may 7, after the investigation of our bureau was completed, zhang was transferred to the people's procuratorate of shuangliu district for review and prosecution on suspicion of the crime of negligent homicide. on june 22, the people's procuratorate of shuangliu district filed a public prosecution against zhang on suspicion of traffic accident with the people's court of shuangliu district.

iii. review of accident responsibility

according to article 119 of the road traffic safety law: "the following terms in this law have the following meanings: (a) road refers to highways, urban roads and places under the jurisdiction of a unit but where motor vehicles are allowed to pass, including squares, public parking lots and other places for public passage." during the court trial, whether the section of the road in the community where the accident occurred complied with the above regulations became a focus of controversy.

on july 15, the shuangliu district people's procuratorate requested the public security organs to issue an accident report on the accident in which zhang mou caused the death of a girl, in accordance with the first paragraph of article 175 of the criminal procedure law, which states that "the people's procuratorate may request the public security organs to provide the evidence materials necessary for the court trial when reviewing a case."

on july 30, the traffic police department of our bureau issued a traffic accident identification, stating that zhang did not pay attention to the road conditions and give way to pedestrians when driving a motor vehicle in a residential area. this behavior violated article 67 of the "road traffic safety law implementation regulations" which states that "in the courtyard of a unit or residential area, motor vehicles should drive at a low speed and give way to pedestrians; if there is a speed limit sign, drive according to the speed limit sign." zhang was found to be fully responsible for the accident. zhang was dissatisfied and filed a review application with the chengdu public security bureau traffic management bureau.

on september 3, the traffic management bureau of the municipal public security bureau reviewed the case and believed that the traffic police department of our bureau still needed to conduct in-depth investigation and further determination.

iv. next steps

at present, the traffic police department of our bureau is further carrying out investigation and evidence collection under the guidance of the traffic management bureau of the municipal public security bureau. it will determine the responsibility in accordance with the law and regulations, promote the litigation of the case in an orderly manner, and fully protect the legitimate rights and interests of all parties involved in the case.
