Recently, Shen Chunyao, director of the Legislative Affairs Commission of the Standing Committee of the National People's Congress, said in an interview that in the next step, the National People's Congress will formulate a number of laws in the field of legislation, including the Private Economy Promotion Law, the Financial Law, and the Ecological Environment Code. For institutional innovation measures that need to be promoted step by step, the "decision + legislation" and "decision + amendment" methods can be adopted, first making relevant decisions in accordance with the law, and then promptly deploying and promoting relevant legislation and amendment work.

Earlier, at the "Promoting High-quality Development" series of thematic press conferences held by the State Council Information Office on August 1, Zhao Chenxin, deputy director of the National Development and Reform Commission, stated that the National Development and Reform Commission is currently working with multiple departments to formulate a law to promote the private economy, protect the property rights and interests of private enterprises and entrepreneurs in accordance with laws and regulations, and improve the system and mechanism for private enterprises to participate in major national strategies.

The Third Plenary Session of the 20th CPC Central Committee released a signal of "unswervingly holding high the banner of reform and opening up". In the "Decision of the CPC Central Committee on Further Comprehensively Deepening Reform and Promoting Modernization with Chinese Characteristics" (hereinafter referred to as the "Decision") reviewed and approved at the meeting, more than 300 important reform measures were proposed.

It can be seen from the content of the "Decision" that the important measures and task requirements deployed by the plenary session include the formulation of the Private Economy Promotion Law, the Financial Law, the compilation of the Ecological Environment Code, etc. Many of them involve the formulation, amendment, abolition, interpretation, compilation of laws and related authorization and approval. The completion of these tasks can only be achieved through new answers through deepening reforms in the legislative field.

All sectors of society have long been looking forward to the formulation of a law to promote private economy.

As we all know, the private economy is not only an important pillar of our national economy, but also a source of power for social innovation and development.

my country's current legal system does not lack content to protect the private economy or ensure that all market players have equal access to resource elements. However, since most of the issues it determines are issues of principle, it is not very practical. On the other hand, state-owned enterprises, foreign companies and other business entities have corresponding laws in the current legal system, but as the most common form of enterprise and market economic entity, private enterprises have not yet received special legislative treatment, which is obviously a shortcoming.

At the same time, with the changes in the global geopolitical and domestic economic environment in recent years, the pressure on enterprises is increasing. In comparison, private enterprises are more vulnerable than other market entities and encounter more difficulties. At this time, a comprehensive and operational law is urgently needed to safeguard the healthy development of the private economy.

From the release of the "Decision" to recent statements, it can be seen that the legislative process of the Private Economy Promotion Law is accelerating.

However, the more important and urgent something is, the more attention should be paid to the quality of legislation. The future law to promote private economy should not only be "good-looking", but also "easy to use".

To achieve this goal, we must widely absorb the wisdom of the people, especially listen to the "urgent needs and concerns" of private enterprises, and make targeted responses in legislation.

What are the main expectations of private enterprises and private entrepreneurs for the Private Economy Promotion Law?

First, we hope to have a transparent and predictable policy environment. This requires that a series of policies around the private economy be established in legal form, and clear compliance standards be established for the standardized operation of private enterprises.

Secondly, we hope to draw a red line for some discriminatory behaviors against private enterprises in the business environment. For a long time, in the same market, there have occasionally been "glass doors" and "spring doors" and other entry barriers for private enterprises, and such discrimination must be prohibited.

Private enterprises and private entrepreneurs hope that their legitimate rights and interests will be firmly protected. It is undoubtedly an opportunity to formulate a law to promote private economy, prohibiting relevant departments from selectively enforcing the law against private enterprises or intervening in civil economic disputes by criminal means, and clarifying the terms of accountability.

Formulating a law to promote the private economy is not just a micro measure for private enterprises, but also a macro strategy related to the "two unshakable" principles.

The rule of law is the best business environment. The introduction of a law to promote the private economy that is actionable, justifiable and enforceable will be a "peace of mind" for private entrepreneurs and society as a whole.
