Recently, a video of a boy in Hebei who accidentally fell while riding a bicycle and was crushed to death by a car in the opposite lane went viral online. According to the verification by Dingdian News reporters, the accident occurred near Nanhoutai Village, Jiaguang Township, Rongcheng County, Hebei Province.
On the afternoon of August 14, a reporter from Dingdian News contacted the People's Government of Jiaguang Township. The staff said that the public security department was investigating the incident. The administrative department of the Rongcheng County Public Security Bureau also stated that the incident was under investigation.
According to Xiaoxiang Morning News, staff from the bidding company for the project on the section where the accident occurred said that the project had not yet been accepted, and the Rongcheng County Transportation Bureau also said that the section had not yet been handed over.
Villagers: The road where the incident occurred is still under construction
Top News reporters saw in the relevant videos that at about 6 a.m. on August 11, a cyclist accidentally fell into the opposite lane when approaching the center line and was then run over by an oncoming car. Two other videos showed that the cyclist who fell to the ground and was run over was a boy. In the video, the boy was lying on the ground with a lot of blood around his head.

On August 13, the Information and Publicity Group of the Health and Family Planning Bureau of Rongcheng County, Hebei Province confirmed that the boy died after failed rescue efforts.
On the afternoon of August 14, Dingdian News contacted a villager near the accident site, who confirmed to the reporter that the road where the accident occurred was a local flood control embankment, which was not yet completed and put into use by the construction party. In response to this statement, Dingdian News contacted the Rongcheng County Traffic Police Brigade and Rongcheng County Transportation Bureau, and the staff replied that they were not clear about the situation.
The above-mentioned villager told the Top News reporter that the nearby villagers were basically aware that the road was still under construction. The villager also said that before the incident, the second intersection of the road where the incident occurred was moved away, and the road has been blocked again this morning.
"Every morning and evening, people go there to enjoy the cool air. It is still very safe if there are no vehicles crossing illegally. After all, bicycles and electric bikes will not cause much harm to people." The villager told the top news reporter that the road is located at the junction of Xiongan New Area and Dingxing County, with a large number of vehicles passing by. Because there are no traffic lights and speed limits on the road, many people choose to take this road.
A reporter from Dingdian News saw in a video shot by a local resident, Mr. Sun, that the intersection where the incident occurred was blocked, and there were many signs with a speed limit of 15km/h on the road. There were also construction cranes operating at the scene, and there were also signs at the scene that read "All personnel and vehicles are prohibited from entering."

Mr. Sun told Dingdian News reporters that there is a river on the north side of the road and Xiongan New Area on the south side. The road has not been completed yet and there are basically no speed bumps. "All the upper and lower openings on both sides are basically blocked. But there is an opening on the Dongmaying side that is open, and there is an opening on the Baigou side that is also open. The rest of the places are basically blocked." Mr. Sun said that some of the openings were opened by villagers for convenience, who poked open the blocked openings and got on the road.

Dingdian News reporters noticed that after the on-site video of the accident was spread online, it attracted the attention of many netizens. One netizen said that someone had previously persuaded the boy's father that the boy was too young to ride, but the father did not accept the netizens' advice. Some netizens also said that the road the driver was driving on was a section that had not been completed and accepted, and he should bear his legal responsibility.
The villagers and Mr. Sun who were interviewed by the Dingdian News reporter said that there are many cyclists on this road. "These cyclists usually set out at 4 or 5 in the morning, rest for about ten minutes at the south back stage, and then go back. Basically, after 7 to 7:30 in the morning, there are basically no cyclists (on the road)." Mr. Sun said that the road construction workers start work at around 8 or 9 in the morning.
Regarding the division of responsibility for the accident, which has attracted the attention of many netizens, Dingdian News interviewed Liu Kai, a lawyer from Beijing Zhongwen (Changsha) Law Firm. Liu Kai said that if the road section has clear no-entry signs and roadblocks, and the driver still enters the unopened road without authorization and an accident occurs, the driver may be deemed to bear the main or full responsibility. And for riding on the unopened road, the boy and his guardian may also be considered to have some fault.
There is a roadblock at the end of the road where the accident occurred
If the boy rides on an unopened road, especially if he fails to comply with safety regulations or enters an obviously unsafe section of the road, he may be found to have some fault, but given the special protection of minors under the law, his liability is usually lighter. Guardians have the responsibility to ensure that their children are active in a safe environment. If a guardian allows a child to ride on an unopened road, especially if he knows that the road is unsafe, the guardian may be considered to have failed to perform reasonable guardianship duties and thus bear certain responsibilities.
Liu Kai said that when organizing cycling activities on unopened roads, organizers should fully evaluate the safety of the roads. If organizers fail to ensure that the activities are carried out in a safe environment, fail to inform participants of potential dangers, or fail to take necessary safety measures, they may be deemed negligent and bear corresponding responsibilities.
In addition, if the section of the road where the accident occurred is an unaccepted construction section, and the project owner and the construction party fail to set up sufficient roadblocks, warning signs or closure measures on the unaccepted road, resulting in vehicles or pedestrians mistakenly entering, the construction party may be considered to have failed to perform safety management responsibilities and thus bear greater responsibility. If the section of the road where the accident occurred is a construction area, and the construction party fails to take necessary safety measures or fails to close the road in time, the construction party may be deemed to have negligence in safety management and thus bear responsibility.
Regarding the latest developments of the incident, on the afternoon of August 14, staff from the Jiaguang Township People's Government and the administrative department of the Rongcheng County Public Security Bureau both responded to Dingdian News reporters that the incident was under investigation.
