in accordance with the anti-dumping regulations of the people's republic of china (hereinafter referred to as the "anti-dumping regulations"), on january 5, 2024, the ministry of commerce (hereinafter referred to as the investigation authority) issued announcement no. 1 of 2024, deciding to conduct an anti-dumping investigation on imported spirits made from distilled wine in containers of less than 200 liters originating in the european union (hereinafter referred to as the investigated products or related brandy).

the investigation authority investigated whether there is dumping and the dumping margin of the investigated products, whether the investigated products have caused damage to domestic industries and the extent of the damage, and the causal relationship between dumping and damage. based on the investigation results and the provisions of article 24 of the anti-dumping regulations, the investigation authority made a preliminary ruling (see annex 1). the relevant matters are hereby announced as follows:

i. preliminary ruling

the investigating authority preliminarily determined that there was dumping of imported relevant brandy originating from the european union, that the domestic relevant brandy industry was threatened with substantial damage, and that there was a causal relationship between the dumping and the threat of substantial damage.

ii. products under investigation and scope of investigation

scope of investigation: imports of spirits derived from distilled wine in containers of less than 200 liters originating in the eu.

iii. preliminary dumping margin

the dumping margins of each company determined by the preliminary ruling are listed in annex 2 to this announcement. no temporary anti-dumping measures will be taken in this case.

iv. comments

all interested parties may submit written comments to the investigating authority within 10 days from the date of publication of this announcement.
