Beijing issues notice on regulating prices and competition in the market for student supplies and related services

In order to protect the legitimate rights and interests of consumers and guide the operators of stationery and other student supplies and glasses and other service operators (hereinafter collectively referred to as "operators") to operate in accordance with the law, operate in good faith, and compete fairly, today, the Beijing Municipal Market Supervision Bureau issued a reminder on further regulating the market prices and competition behaviors of student supplies and related services:
1. Operators must consciously abide by the law. Operators must strictly abide by the "Price Law of the People's Republic of China", "Anti-Unfair Competition Law of the People's Republic of China", "Regulations on Clearly Marking Prices and Prohibition of Price Fraud" and other laws and regulations and relevant provisions, follow the principles of fairness, legality and honesty, reasonably set prices for student supplies and related services in accordance with the law, strengthen price self-discipline, and maintain a good market price and competition order.
2. Do a good job of clearly marking prices. Operators must conscientiously implement relevant regulations on clearly marking prices, fully protect consumers' right to know, ensure that prices are true and accurate, that goods and labels are aligned, and that labels are eye-catching. If prices of goods or services change, they must be adjusted in a timely manner. When selling student supplies such as stationery, the name, price, and unit of measurement of the goods should be marked in accordance with the law to avoid situations such as selective pricing, unclear marking, and misalignment of goods and labels. When providing services such as fitting glasses, the service items, service content, and prices or pricing methods should be marked to avoid charging fees that are not marked.
3. Price fraud is prohibited. Operators shall not use false or misleading price means to deceive consumers or other operators to trade with them. When operators compare prices, the price information marked as compared shall be true and accurate. When selling student supplies or providing services through various means such as physical stores, e-commerce platforms, live marketing, etc., price fraud such as low prices to deceive high prices, false discounts or price comparisons, and failure to fulfill price commitments shall not occur.
4. Fair participation in competition. When selling student supplies or providing services, operators shall not use commercial logos that are identical or similar to other well-known product names, packaging, decoration, company names, etc. without authorization, and shall not make false or misleading commercial propaganda about the performance, function, quality, sales status, user evaluation, honors, etc. of the products. For those who engage in production and business activities through the Internet and other information networks, according to the "Interim Provisions on Anti-Unfair Competition on the Internet" (officially implemented on September 1, 2024), they shall not engage in unfair competition on the Internet, disrupt the market competition order, and affect fair market transactions.
5. Implement the principal responsibility. All shopping malls, shopping malls, markets, online trading platform operators and other trading venue providers should strengthen the regulation and guidance of the prices and competitive behaviors of operators in the venues (platforms). Online trading platform operators shall not use technical means to force operators in the platform to make false or misleading price markings. Industry organizations should strengthen industry self-discipline and actively regulate the prices and competitive behaviors of members.
The Beijing Municipal Market Supervision Bureau stated that all operators in the city should carefully check and rectify the above requirements, conduct self-examination and self-correction in a timely manner, and properly handle all kinds of disputes. The city's market supervision departments will further increase law enforcement inspections, keep a close eye on complaints and reports from the public, and investigate and deal with all kinds of price violations and unfair competition behaviors in accordance with the law.
