national parks protect the most important natural ecosystems in my country, the most unique natural landscapes, the most essential natural heritage, and the richest biodiversity. on september 10, the draft national park law was submitted to the standing committee of the national people's congress for deliberation for the first time. this is the first time that my country has enacted special legislation for national parks at the national level, which will provide a legal basis for the planning and establishment, protection and management, participation and sharing, protection and supervision of national parks.
a national park refers to a specific land or marine area that is approved and managed by the state, has clear boundaries, and aims to protect large-scale natural ecosystems that are representative of the country, and to achieve scientific protection and rational use of natural resources. as a type of protected area, national parks are of great significance to protecting the authenticity and integrity of natural ecology and natural and cultural heritage. in october 2021, my country officially established the first batch of five national parks, including sanjiangyuan, giant panda, northeast tiger and leopard, hainan tropical rainforest, and wuyi mountain, with a protected area of ​​230,000 square kilometers, covering nearly 30% of the land-based national key protected wild animal and plant species. the protection and management of national parks has since risen to a strategic height to ensure national ecological security and species security.
the establishment of a national park system is one of the key reform tasks proposed by the third plenary session of the 18th cpc central committee and an important part of china's ecological civilization system construction. although my country has formulated more than 10 systems, methods and standards for the establishment, monitoring and evaluation of national parks in recent years, there is no special superior law at the national level for national parks, and there is no clear legal basis for dealing with problems arising from the protection and management of national parks, which highlights the urgency and necessity of keeping pace with the times and building a legal foundation for their protection and management.
law is an important tool for governing the country and benefiting the people. improving the level of legalization of national park protection and management and improving legislation are the only way. at present, my country's laws and regulations on national park protection and management are scattered in the environmental protection law, urban and rural planning law, land management law, mineral resources law, nature reserve regulations, scenic spots regulations, and paleontological fossil protection regulations. the decentralized legal norms and non-specialized legislation have long affected the effectiveness of law enforcement and law-abiding. in this case, it is imperative to use the rigid constraints of special laws to provide a "green shield" for the protection and management of national parks in a timely manner.
the protection and management of national parks is related to the national ecological security and species safety. it is necessary to regulate the establishment conditions, demarcation, management agencies, planning, internal functional zoning, restrictions on development and utilization activities, supervision system, ecological compensation and legal responsibilities of national parks. the solution to these problems is a matter of great importance. only by systematic legislation and the overall formulation of a superior law that consolidates the foundation, stabilizes expectations and benefits the long-term can we make institutional arrangements for the protection and management of all aspects of national parks and ensure that the protection and management of national parks are standardized under the rule of law.
in addition, the formulation of a special law for national parks is also an inevitable requirement for solidifying practical experience. in recent years, governments and functional departments at all levels, from the central to the local level, have actively explored legislation for the protection and management of national parks, and have gained a lot of useful experience in practice. only by solidifying these useful experiences at the legal level can they be more authoritative and be smoothly passed on.
law is not only a norm, but also a guarantee. formulating special laws is not only conducive to the protection and management of national parks, but also conducive to solidifying the useful experience in practice in the name of special laws, and solving the problem of ineffective protection and management of national parks to the greatest extent. now, the long-awaited draft of the national park law has been formally submitted for review, which can be said to be just in time. i believe that with the introduction of the national park law, a more standardized and efficient national park protection and management system will be better established in accordance with the law.
