kuai technology news on october 4, the u.s. attorney’s office for the district of columbia recently announced thatchinese men haotian sun and pengfei xue, 34, were sentenced for defrauding apple of millions of dollars worth of iphones by exchanging them for new ones.
u.s. district court judge timothy j. kelly sun was sentenced to 57 months in prison and xue jun was sentenced to 54 months in prison.
sun haotian and xue pengfei are from baltimore and germantown, maryland respectively. according to the government's evidence, between may 2017 and september 2019,sun, xue and other conspirators profited by submitting counterfeit iphones to apple for repair and having apple replace them with genuine iphones.
sun and xue received a shipment of counterfeit iphones from hong kong at a ups mailbox in the washington, d.c., metropolitan area. they then submitted the counterfeit iphones with fake serial numbers and imei numbers to apple retail stores and apple authorized service providers.
trial evidence showed that members of the conspiracy submitted more than 6,000 counterfeit iphones to apple, causing actual losses of more than $2.5 million.
both men will undergo three years of supervised release after serving their sentences and will be required to pay restitution to apple. sun was ordered to pay $1,072,000, while xue was ordered to pay $397,800.
back in february, the two were convicted of mail fraud and conspiracy to commit mail fraud, charges that carry a maximum penalty of 20 years in prison.
