phoenix.com technology news: on monday, september 17, beijing time, tiktok and the u.s. department of justice held oral arguments in the d.c. circuit court of appeals on the mandatory divestiture law, which could soon ban tiktok. during the debate, tiktok urged the court to stop the law, arguing that banning its app would have "alarming" consequences for freedom of speech in the united states.

according to the law signed by biden in april this year, bytedance needs to sell tiktok’s us business to a non-chinese company before january 19, 2025, otherwise tiktok will be banned in the united states.

at monday's hearing, tiktok's attorney, andrew pincus, a partner at mayer brown, cited free speech protections in the first amendment of the u.s. constitution to rebut the argument that tiktok posed a national security threat.

"for the first time in history, congress has explicitly targeted a single american speaker and banned the speech of that speaker and 170 million americans," pincus said. "this law imposes an extreme ban on speech based on uncertain future risks." he added that the u.s. government is "far from" proving the law's constitutionality.

pincus said the u.s. government should look into remedies, such as forcing tiktok to "disclose" any potential propaganda found on its platform, rather than banning the app outright.he noted that the divestiture law was effectively a ban and that selling tiktok was "unfeasible" because a standalone u.s. app would be impossible.

the hearing lasted about two hours. the three judges asked tiktok and the u.s. department of justice probing questions. lawyers for both sides asked the judges to make a ruling before december 6 this year. legal experts predict that the losing party will appeal to the u.s. supreme court.
