Recently, Chengdu residents Ms. Chen and Mr. Jiang reported to Sichuan Radio and Television Station's "Sunshine Government Affairs" that they paid a 100,000 yuan franchise fee to be the agent of Yiguolian Fruit Store in Shuangliu District, but they wanted a refund just over a month after signing the contract. What's going on?
On August 17, the reporter met Ms. Chen and Mr. Jiang in Shuangliu District. They told the reporter that at the end of June this year, they signed a cooperation agreement with Chengdu Yiguolian Commercial Management Co., Ltd. to be the agent of Yiguolian fruit stores in Shuangliu District. The two parties agreed in the contract that Party A (Chengdu Yiguolian Commercial Management Co., Ltd.) would settle commissions with Party B (Mr. Jiang and Ms. Chen) according to the actual number of customers who have cooperated with Party B in the authorized area (Shuangliu District) as agreed in the agreement.
After paying the money and signing the contract, Ms. Chen and Mr. Jiang searched online and found that there was already a Yiguolian chain fruit store in Shuangliu District. They believed that as agents in Shuangliu District, they should collect the corresponding commission from the fruit store in accordance with the contract. In response, Ms. Wang, the relevant person in charge of Chengdu Yiguolian Commercial Management Co., Ltd., said that when signing the contract with Ms. Chen and Mr. Jiang, there was indeed a Yiguolian fruit store in Shuangliu District, but it existed before the contract was signed and did not fall within the scope of the need to pay commissions to the two. The two parties disagreed on the agreed content of the contract: "Party A shall settle commissions with Party B according to the actual number of customers who have cooperated with Party B in the authorized area in accordance with the agreement."
Ms. Wang disagrees with the refund request made by Ms. Chen and Mr. Jiang. Currently, the two parties are still negotiating on the matter. If the negotiation fails, the two parties will resolve the matter through legal means.
