On August 15, Ele.me announced that it would open source 10 patents and complete the public listing on the Shanghai Technology Exchange. This is also the first batch of open source patents in China to be publicly listed through the national technology factor market. Among the 10 patents, 7 are in the field of food safety, 3 are in the field of low-carbon environmental protection, and a total of 3 are AI-related patents.

The 10 open-source patents can be found on the official website of Shanghai Technology Exchange. The webpage shows that their listing prices are all zero yuan, and the project information also discloses their open-source conditions. According to the definition and description in "Patent Open-Source Strategy and Risk Prevention and Control" organized and compiled by the Academic Committee of the State Intellectual Property Office, patent open-source means that patent holders, under certain conditions, allow some or all of the patents they hold to be implemented by unspecified persons at zero royalties in order to build a target patent ecosystem.
Hao Peng, head of the Ele.me patent open source working group, said that Ele.me's move was in response to the "Special Action Plan for Patent Transformation and Utilization (2023-2025)" and the "Shanghai Patent Transformation and Utilization Special Action Implementation Plan", exploring the way of open source patents to gather more companies to participate and continuously innovate, promote the improvement of food safety governance at the social level, and use digital technology to help achieve the "dual carbon" goals.
Patent open source can give full play to the rights and interests bond and information link function of patents in the innovation chain, strengthen the role of patents in strengthening the chain and increasing efficiency in the industrial chain, and is an effective measure to accelerate the development of new quality productivity. A well-known patent open source case is Tesla, which is generally believed in the industry to have promoted the overall development of the electric vehicle industry.
Hao Peng believes that by relying on the Shanghai Technology Exchange to explore open source patents, it is possible to leverage the credibility and platform benefits of the national technology factor market to make the open source of patents traceable, open and transparent throughout the process. At the same time, the construction of the patent open source ecosystem will be more efficient and able to connect with more companies with the same ideas.
