The little yellow calf that refused to return
In March 2023, Nong, who lived in a village in Hezhou, Guangxi, grazed 22 yellow cattle of different sizes on the mountain opposite the village. Pen, who lived in the next village, also grazed his own 8 cattle on the mountain. One day in September 2023, when Nong went to the mountain to check on the cattle, he found that a one-year-old yellow cattle was missing. After searching for many days, he found nothing. Two months later, Nong learned that his lost yellow cattle might be in Pen's cattle pen. After learning about the situation, Nong found Pen to negotiate, but Pen insisted that the yellow cattle were born by his own cow and refused to return them.
The dispute was mediated many times by the village committee, judicial office, police station, township government and other departments, but both parties insisted on their own opinions and could not reach a mediation agreement. Nong then applied for DNA identification of the cows he raised and the calf involved in the case. On January 19, 2024, the Animal Disease Prevention and Control Center of Zhongshan County, Hezhou City, Guangxi Zhuang Autonomous Region sent technicians to collect blood from the two cows mentioned above. A Beijing Biotechnology Co., Ltd. issued a "Consulting Opinion" based on the blood samples: Based on the existing information and DNA test results, it supports that Sample 1 and Sample 2 have a biological parent-child relationship. After the identification results came out, Pen still refused to return it. For this reason, Nong sued Pen to the People's Court of Zhongshan County, Guangxi Zhuang Autonomous Region, requesting Pen to return the calf and pay an identification fee of 5,000 yuan and a loss of work fee of 3,000 yuan.

The court convened both parties for mediation. Pen had no objection to the appraisal result, but was only willing to bear half of the appraisal fee and asked for a deduction of 3,000 yuan for one year's feeding fee. After the judge explained the law and reasoning, the two parties finally reached a mediation opinion. Pen agreed to return the calf and pay the appraisal fee of 5,000 yuan in court. Witnessed by the court staff and police from the police station, Nong took the calf back home that day.

Mistakenly leading livestock to other animals is common among farmers, especially when the cattle of both parties are raised on the same mountain. The judge kindly reminded farmers to mark their livestock as much as possible during breeding or grazing, or keep relevant videos, photos and other materials, so that they can protect their rights and interests in a timely and effective manner in case of disputes.
