Newly revised regulations on military pensions and benefits announced

The State Council and the Central Military Commission recently announced the newly revised "Regulations on Military Personnel Pensions and Benefits" (hereinafter referred to as the "Regulations"), which will come into effect on October 1, 2024.

The newly revised "Regulations" are aimed at guaranteeing the state's pensions and preferential treatment for soldiers, encouraging soldiers to devote themselves to defending and building the motherland, strengthening national defense and military modernization, and making soldiers a profession respected by the whole society. The newly revised "Regulations" consists of 6 chapters and 64 articles. The main contents of the revision are as follows.

First, we must uphold the leadership of the Party and clarify the basic principles of military pensions and preferential treatment. Military pensions and preferential treatment must uphold the leadership of the Communist Party of China and implement the principles of matching treatment with contribution, giving equal weight to spiritual and material, and combining care with service. We must improve the dynamic adjustment mechanism for pensions and preferential treatment standards to ensure that the level of pensions and preferential treatment is consistent with the level of economic and social development, national defense, and military construction.

Second, improve the system and mechanism to adapt to the new situation and requirements of national defense and military construction. Clarify the scope of pensions and preferential treatment recipients and the content of pensions and preferential treatment. Clarify the management system and stipulate the pension and preferential treatment responsibilities of the competent departments for retired military personnel, other relevant agencies, and relevant military departments. Clarify the financial responsibilities of the central and local governments. Improve the military-civilian connection mechanism for the assessment of martyrs and the issuance of disability pensions.

Third, increase the measures for preferential treatment and strengthen the service guarantee. It is stipulated that the recipients of preferential treatment shall enjoy social security, basic public services and corresponding preferential treatment. The honor incentive shall be enhanced by increasing the pension to the surviving families of the recipients of meritorious service and honors, inviting the recipients of preferential treatment to participate in major celebrations, etc. A caring and assistance mechanism shall be established to increase the caring and assistance for the recipients of preferential treatment who are in special difficulties.

Fourth, optimize the procedures for preferential treatment of the disabled and improve service capabilities and levels. Clarify the procedures for the issuance of one-time pensions and protect the legitimate rights and interests of the recipients of preferential treatment of the disabled and increase the circumstances for re-applying for disability assessment.
