the case file shows that from 2018 to march 2021, the defendant sun sold silverfish at a stall in a wholesale agricultural product market. in order to store the silverfish for a longer time at room temperature, sun soaked the silverfish in industrial formaldehyde solution, knowing that industrial formaldehyde was toxic and harmful to the human body, and sold the soaked silverfish to vendors in kunshan city, jiangsu province and other places, with a total sales amount of more than 1.29 million yuan.

since 2020, sun moujie hired the defendant liu moujun to help at his stall, soaking whitebait in industrial formaldehyde solution, and liu moujun participated in sales totaling more than 670,000 yuan. after inspection by the kunshan food quality inspection center, industrial formaldehyde was detected in the whitebait sold by sun moujie.

according to the supreme people's procuratorate, the people's procuratorate of kunshan city, jiangsu province, prosecuted the defendants sun moujie and liu moujun for the crime of producing and selling toxic and harmful food. after trial, the kunshan people's court determined that the defendants sun moujie and liu moujun mixed toxic and harmful non-food raw materials into the food they produced and sold, and their actions constituted the crime of producing and selling toxic and harmful food.

the sales amount of the two reached more than 1.29 million yuan and more than 670,000 yuan respectively, both of which were particularly serious circumstances and should be punished according to law. in the joint crime, sun moujie was the principal offender and liu moujun was the accomplice. liu moujun can be given a lighter punishment according to law. both defendants pleaded guilty and accepted punishment, and can be treated leniently according to law. based on this, the defendant sun moujie was sentenced to eleven years in prison and a fine of rmb 3 million for the crime of producing and selling toxic and harmful food; the defendant liu moujun was sentenced to five years in prison and a fine of rmb 200,000.
