xiaomi group has asked india’s antitrust regulator to withdraw its report that found xiaomi and walmart inc’s flipkart had violated competition laws, two people familiar with the matter said, citing two people familiar with the matter.

if the competition commission of india (cci) withdraws its report, it could delay its antitrust investigation that was due to begin in 2021.in august this year, the committee rarely withdrew an antitrust report on apple because apple also complained that the report disclosed the company's trade secrets.

in its application to the competition commission of india, xiaomi said the flipkart investigation report contained sensitive business data of xiaomi that should have been blacked out when shared with parties involved in the case, the people said.one of xiaomi's concerns about the flipkart report is that it includes sales data broken down by phone model, which is sensitive information.

reuters reported in mid-month that the competition commission of india said in a report dated august 9 that amazon and flipkart favored certain sellers, gave priority to selling certain goods, and colluded with samsung, xiaomi, vivo, lenovo and other companies to exclusively release mobile phones on their websites, violating antitrust laws. according to data from research firm counterpoint research, samsung and xiaomi are the two largest smartphone manufacturers in india, accounting for nearly 36% of the market share together, while vivo has a 19% share.

the competition commission of india did not make the investigation report public but only shared it with parties involved in the case.if the competition commission of india withdraws the report, this requires the parties concerned to return the report, which is then further scrutinized for redactions.

xiaomi is not concerned about the data in the report against amazon, which alleges collusion between the two companies in online sales in violation of antitrust laws, the people said. xiaomi wants the competition commission of india to require all parties to return the reports and destroy all copies so it can further redact sensitive information before re-sharing them.

previously, the competition commission of india withdrew its antitrust report against apple, which found that apple exploited its dominant position in the ios app store market.however, apple has denied any wrongdoing.

as of press time, xiaomi, flipkart and the competition commission of india have not commented. (author/xiao yu)
