who bears the compensation liability? the expenses incurred by the emergency rescue team in participating in the emergency rescue of accidents and disasters in accordance with the orders issued by the dispatching unit shall be determined by the subject of compensation liability according to the following circumstances: if there is a responsible unit for the accident, the responsible unit shall bear the compensation liability; if there is no clear responsible unit for the accident or the responsible unit is unable to bear it, as well as the expenses incurred by the emergency rescue of natural disasters, the city and county finances of the place where the incident occurred shall bear the compensation liability. if the city and county finances of the place where the incident occurred have difficulties in paying the compensation costs, they may apply for appropriate subsidies from the superior finances. the expenses of the emergency rescue teams of our province supporting other provinces shall be compensated by the governments of the supported areas. if the expenses are not compensated by the supported areas, the dispatching unit shall coordinate with the finances at this level to bear the expenditure responsibility.

what is the compensation standard? the cost of emergency rescue and relief for accidents and disasters refers to the actual expenditures in the process of emergency rescue and relief for accidents and disasters, mainly including labor allowances, board and lodging expenses, equipment expenses, material expenses, transportation expenses and other expenses. among them, labor allowances refer to the subsidy for staff involved in emergency rescue and relief. labor allowance = labor allowance standard × actual number of rescuers × number of rescue days. the standard of labor allowance refers to the provisions of the labor law on statutory holidays, rest days, and extended working hours subsidies. in principle, it is determined at twice the average daily wage income of employees in urban private units in our province in the previous year. the number of emergency rescue teams is determined according to the actual number of people on duty, and the number of emergency rescue days is the total number of days from the time the emergency rescue team receives the dispatch order and sets out from the base to the time the rescue mission is completed and returns to the base.

how to apply for compensation? within 15 working days after the emergency rescue work is completed, the team participating in the emergency rescue shall fill out the application form for compensation for accident and disaster emergency rescue expenses, and attach the dispatch form and arrival confirmation form, relevant bills and other supporting materials. after being signed by the main person in charge and stamped with the official seal of the unit, it shall be submitted to the county-level emergency management department or the emergency rescue leading department where the incident occurred. the county-level emergency management department or the emergency rescue leading department where the incident occurred shall review the compensation expenses according to the standards stipulated in these measures.

when can i get the compensation? the compensation funds will be paid according to the following circumstances: if the county-level finance of the place where the accident occurred is responsible for the compensation, the compensation fee will be paid within 10 working days after the review and approval; if the city-level finance of the place where the accident occurred is responsible for the compensation, the city-level emergency management department or the emergency rescue leading department will review the compensation fee and pay the compensation fee within 10 working days; if the unit responsible for the accident is responsible for the compensation, the unit responsible for the accident will confirm the compensation fee and pay the compensation fee within 10 working days.

what should i do if my personal materials are requisitioned? if, due to the need for disaster relief, the emergency rescue command or the leading department of the emergency rescue approves and agrees to rent or requisition materials from relevant organizations or individuals, compensation will be made in accordance with this "measures".
