samsung, xiaomi and other smartphone companies colluded with amazon and walmart’s flipkart to sell products exclusively on the e-commerce companies’ indian websites, a regulatory report showed, violating antitrust laws.

reuters reported earlier this week that an antitrust investigation by the competition commission of india (cci) found that amazon and flipkart had violated local competition laws by favouring certain sellers, prioritising certain items and selling products at heavy discounts at the expense of other companies.

the report is dated august 9 this year and has not yet been released publicly.smartphone companies were also accused of anti-competitive behavior in the report, which was first reported by reuters.

in its 1,027-page report on amazon, the cci also mentioned that the indian units of five companies - samsung, xiaomi, motorola, realme and oneplus - "colluded with amazon and its affiliates to exclusively launch mobile phones on the platform", violating competition laws.

in its 1,696-page report on flipkart, the competition commission of india said the indian units of samsung, xiaomi, motorola, vivo, lenovo and realme had also engaged in similar practices.

both cci reports said that during its investigations, amazon and flipkart "deliberately downplayed allegations of exclusive releases of phones," but officials found the practice "widespread."

the inclusion of smartphone makers such as samsung and xiaomi in the case could increase their legal and compliance problems.“exclusivity in business is abominable. it is not only against free and fair competition but also against the interest of consumers,” cci deputy director general gv siva prasad wrote in his reports on amazon and flipkart, reaching the same conclusion in both cases.
