One day in April this year, at 22:30, the mobile phones of villagers in a village in Sangzidian Street, Tianqiao District, Jinan City, Shandong Province suddenly rang. Many villagers who had already fallen asleep were awakened by the sudden and intensive message alerts.

It turned out that the three people started a verbal fight in the village WeChat group because of a family dispute. Many villagers came forward to "stop the fight", but the three people cursed each other so hard that 446 villagers in the group watched the three people cursing each other for more than an hour. After the incident, with the joint mediation of the police and village cadres, the family put aside their differences and expressed their apologies for insulting each other online.
After investigation, Cui Mou, Zhou Mouyu and Zhou Moukai confessed to their behavior of insulting others in the WeChat group. According to the "Public Security Administration Punishment Law of the People's Republic of China", the three have been administratively detained by the Tianqiao District Public Security Bureau of the Jinan Public Security Bureau in accordance with the law.

In this regard, Wang Yiyun, a lawyer from Zhejiang Lunhe Law Firm, explained that WeChat groups composed of unspecified people have the attributes of public spaces. Citizens who post insulting, defamatory, slanderous or disparaging remarks about others in such WeChat groups constitute infringement of their reputation rights and should bear legal responsibility in accordance with the law. This may result in many legal consequences, including civil, administrative and criminal liability.
Wang Yiyun introduced that from the perspective of civil liability, if the insulting remarks constitute an infringement on the reputation rights of others, the relevant responsible persons may bear civil liabilities such as eliminating adverse effects, repairing damaged reputation, making public apologies, and compensating for economic losses, according to the second paragraph of Article 42 of the Civil Code.
From the perspective of administrative responsibility, according to the "Public Security Administration Punishment Law of the People's Republic of China", anyone who openly insults others or fabricates facts to slander others shall be detained for not more than five days or fined not more than 500 yuan; if the circumstances are serious, he shall be detained for not less than five days but not more than ten days, and may be fined not more than 500 yuan.
"From the perspective of criminal responsibility, if the insulting behavior is serious, it may be suspected of insult or defamation. If the circumstances are serious, the offender may be sentenced to fixed-term imprisonment of not more than three years, detention, control, or deprivation of political rights," said Wang Yiyun.
