Recently, the First Inspection Bureau of Dongying Municipal Taxation Bureau of the State Administration of Taxation made public the penalty decision for the case of "Qicheng Energy (Dongying) Co., Ltd. - Evasion of Tax Payment" (Dongying Tax Inspection No. 1 Penalty [2024] No. 19), and punished Qicheng Energy (Dongying) Co., Ltd. in accordance with the law.
The reasons for punishment disclosed in the penalty decision show that the illegal facts of Qicheng Energy (Dongying) Co., Ltd. mainly include: collecting 495,875.22 yuan of business funds in cash from 2021 to 2023 without declaring sales revenue, and committing tax evasion; after the consumption of the issued stored-value cards was completed, the income was not transferred to the prepayments in a timely manner, and from July to December 2023, there was a problem of not timely recognizing income for prepayments of 5,309,538.46 yuan (excluding tax); the annual corporate income tax report from 2022 to 2023 was corrected and declared to reduce the amount of losses that can be offset before tax.
In accordance with the "Tax Collection and Management Law of the People's Republic of China" and the "Shandong Province Tax Administrative Penalty Discretion Criteria", the First Inspection Bureau of the Dongying Municipal Taxation Bureau of the State Administration of Taxation intends to impose a fine of 782,660.41 yuan, which is 1 times the amount of tax underpaid, on Qicheng Energy (Dongying) Co., Ltd. for failing to timely recognize income in 2023 and underpaying VAT of 64,463.76 yuan, urban maintenance and construction tax of 27,493.45 yuan, and corporate income tax of 463.19 yuan for cash collection of business funds from 2021 to 2023. The total fine payable is 782,660.41 yuan.
