On August 14th local time, the Constitutional Court of Thailand read out the verdict on the qualifications of the current Prime Minister Setiawan. The court ruled that Phichit's appointment as Minister of the Prime Minister's Office in this year's cabinet reshuffle violated the law. As Prime Minister, Setiawan was directly responsible and needed to terminate his post. He will no longer serve as Prime Minister of Thailand.

On May 16, 40 of the 250 members of the Thai Senate jointly submitted a petition to the Constitutional Court requesting the termination of Prime Minister Setha and then-Minister of the Prime Minister's Office Phichit. The members who signed the petition believed that Phichit's appointment as Minister of the Prime Minister's Office during the cabinet reshuffle violated the law, and Setha, as Prime Minister, was directly responsible and needed to be terminated, so they asked the Constitutional Court to review and rule. On May 21, Phichit resigned as Minister of the Prime Minister's Office.

On August 22, 2023, the results of the Thai Prime Minister election were announced. Setha Thavithin, the prime ministerial candidate nominated by the Pheu Thai Party, was elected as the new prime minister as the only candidate.
