According to the official website of Beijing Municipal Administration for Market Regulation, Beijing Yuanbao Yimei Consulting Co., Ltd. was recently fined a total of more than 7.47 million yuan by the Beijing Haidian District Market Supervision Bureau for selling a certain brand of imported cosmetics that had not been registered.
The administrative penalty decision document published on the official website of the Beijing Municipal Administration for Market Regulation shows that on November 14, 2023, the Beijing Haidian District Administration for Market Regulation received a report from a limited company that is the agent of a certain brand of cosmetics in China, reporting that the store "Yuanbao's Skin Care Sharing" opened by Beijing Yuanbao Yimei Consulting Co., Ltd. on "Taobao.com" sold a certain brand of imported cosmetics that had not been registered.
On November 30, 2023, the Haidian District Market Supervision Bureau conducted an on-site inspection of the business premises and Taobao store warehouse of Beijing Yuanbao Yimei Consulting Co., Ltd. located at 9205, 9th Floor, East Building, No. 15, West Fourth Ring Road North, Haidian District. On-site, 14 cosmetics of a certain brand that could not provide cosmetics filing qualifications were pre-registered and preserved. No raw materials, packaging materials, tools, or equipment used to produce cosmetics were found during the inspection.
After verification, the case involved multiple Taobao store names such as "Yuanbao's Skin Care Sharing", "Yuanbao's Skin Care Sharing a Genuine Product", and "Yuanbao's Skin Care Sharing Manjusri", but the "ID" of all the Taobao stores involved was "Youzang Yao Fenglin", and the store "ID" number was 131221870, which means it was the same store. The actual operator was Beijing Yuanbao Yimei Consulting Co., Ltd.
The parties involved claimed that some of the cosmetics involved were auctioned after being confiscated by the customs, and provided relevant materials to prove the legality and source of the cosmetics involved. However, the Haidian District Market Supervision Bureau did not find the filing or registration information of the cosmetics involved. After investigation and verification with a company that is the agent of a certain brand of imported cosmetics in China, it was found that none of the cosmetics involved had obtained the filing of imported cosmetics.
After investigation and verification, the party sold 14 types of ordinary cosmetics of a certain brand that were not registered through the Taobao store "Yuanbao's Skin Care Sharing" (store ID: 131221870), with a sales amount of RMB 989,782.63. The on-site inspection found 14 types of ordinary cosmetics of a certain brand that were not registered, with a total amount of RMB 76,703.
In accordance with the relevant provisions of the "Regulations on the Supervision and Administration of Cosmetics", the Haidian District Market Supervision Bureau ordered the parties to correct the above-mentioned illegal acts, and decided to impose a fine of RMB 6,398,913.78, confiscate illegal gains of RMB 989,782.63, and confiscate illegal property.
