The Ministry of Industry and Information Technology plans to strengthen supervision of OTA upgrades for intelligent connected vehicles

According to the website of the Ministry of Industry and Information Technology, in order to further strengthen the access, recall and online upgrade management of automotive software of intelligent connected vehicles equipped with combined driving assistance systems, the Equipment Industry Department of the Ministry of Industry and Information Technology and the Quality Development Bureau of the State Administration for Market Regulation organized the preparation of the "Notice on Further Strengthening the Access, Recall and Online Upgrade Management of Intelligent Connected Vehicles (Draft for Comments)".

The draft opinion mentioned that supervision and management of OTA upgrade activities should be strengthened. Before implementing OTA upgrade activities, enterprises should ensure that automobile products comply with relevant requirements such as national laws and regulations, technical standards and technical specifications, and file with the Ministry of Industry and Information Technology and the State Administration for Market Regulation in accordance with relevant requirements. The filing content includes enterprise management capabilities, vehicle models and functions, specific upgrade activities and relevant supporting materials. Only after the filing is completed, the enterprise can carry out OTA upgrade activities. If it involves changing the technical parameters of the product, it should be reported to the Ministry of Industry and Information Technology before filing to ensure the consistency of automobile product production. The State Administration for Market Regulation promptly conducts filing assessments and supervision and inspections, standardizes the application methods of OTA upgrades, and prevents enterprises from concealing vehicle defects or evading responsibilities through OTA upgrades. If OTA upgrades are used to eliminate defects in automobile products and implement recalls, a recall plan should be formulated in accordance with the "Implementation Measures for the Regulations on the Recall Management of Defective Automobile Products" and filed with the State Administration for Market Regulation in a timely manner.

The parents of a motorcyclist who was killed in a 2022 Tesla Model 3 Autopilot accident in Utah are suing Tesla and the vehicle's driver, claiming that the driver-assistance software and other safety features were "defective and inadequate."

According to a lawsuit filed by the deceased's parents in the Salt Lake City State Court, 34-year-old Landon Embry was riding a motorcycle and collided with a Model 3 in autopilot mode. The Model 3 hit the back of the Harley-Davidson motorcycle at a speed of 75-80 miles (about 120.7-128.75 kilometers) per hour, and Landon Embry fell off the motorcycle and died on the spot.

The lawsuit claims that the Model 3 driver was "tired" and "unfit to act as a driver who normally needs to drive with caution," and also mentions that "a careful driver, or an adequate automatic braking system, could have slowed or stopped the vehicle without colliding with the motorcycle."
