The draft opinion mentioned that supervision and management of OTA upgrade activities should be strengthened. Before implementing OTA upgrade activities, enterprises should ensure that automobile products comply with relevant requirements such as national laws and regulations, technical standards and technical specifications, and file with the Ministry of Industry and Information Technology and the State Administration for Market Regulation in accordance with relevant requirements. The filing content includes enterprise management capabilities, vehicle models and functions, specific upgrade activities and relevant supporting materials. Only after the filing is completed, the enterprise can carry out OTA upgrade activities. If it involves changing the technical parameters of the product, it should be reported to the Ministry of Industry and Information Technology before filing to ensure the consistency of automobile product production. The State Administration for Market Regulation promptly conducts filing assessments and supervision and inspections, standardizes the application methods of OTA upgrades, and prevents enterprises from concealing vehicle defects or evading responsibilities through OTA upgrades. If OTA upgrades are used to eliminate defects in automobile products and implement recalls, a recall plan should be formulated in accordance with the "Implementation Measures for the Regulations on the Recall Management of Defective Automobile Products" and filed with the State Administration for Market Regulation in a timely manner.
