xu xiaohang has set fishing rules for yuyue fishing park, charging between 100 and 300 yuan per 8 hours, depending on the time the anglers enter the park. after catching fish at yuyue fishing park, anglers can choose to take the fish away directly or "return the fish". the so-called "returning the fish" means that xu xiaohang will recycle the fish at a certain price and put it back to the fishing ground.

xu xiaohang runs yuyue fishing park steadily.it was not until the beginning of 2022 that he felt that ordinary fishing parks did not make much money, so he began to study new ways of fishing.

xu xiaohang set the fee for the traditional method at 300 yuan per 6 hours. anglers who choose the traditional method can only fish grass carp, bighead carp and other fish species. the fee for the "standard fish" method is twice that of the traditional method, that is, 600 yuan per 6 hours. anglers who choose the "standard fish" method can fish for "standard fish" and "return the fish" according to the price of the "standard fish" to get cash or cigarettes, alcohol and other commodities of the same price. in addition, anglers can also use the price of the "standard fish" to deduct tickets and meals in the fishing park.

the tricks of "marking fish" are very complicated

after the "mark fish" game was introduced, many anglers were eager to try it out, wanting to catch the high-value "mark fish" in one fell swoop.some anglers at yuyue fishing park feel that fishing itself is an entertainment activity, and the price of “marking fish” is affordable and more interesting and exciting. therefore, they do not care much about whether they can make a profit or not. “we know that the boss must make money, and fishing itself is a game process.”

it was precisely by grasping this mentality of many anglers that xu xiaohang continued to release "standard fish" and gradually added 59 "standard fish". relying on this way of playing, he made the fishing park's business more and more prosperous.

yichang's first case of opening a casino by operating a fishing park

on august 10, 2023, the yidu city public security bureau discovered that xu xiaohang had opened a casino in yidu city by operating a fishing park. on the same day, police officers from the yidu city public security bureau arrested xu xiaohang at the fishing park.

on november 14, 2023, the yidu city public security bureau completed the investigation and transferred the case to the yidu city procuratorate for review and prosecution.

after review, the yidu city procuratorate believed that around 2019, xu xiaohang rented a venue and opened yuyue fishing park. in the process of operating the fishing park, xu xiaohang came into contact with the "marked fish" fishing method through an online platform and went to similar fishing grounds to learn. in april 2022, he released more than 70 black carps in yuyue fishing park and tied plastic fish-shaped tags with different numbers ranging from 200 to 10,000 on the fins of the black carps. participants in "marked fish" fishing must pay an entrance fee of 600 yuan (600 yuan/6 hours). on this basis, they can recharge at least 3,000 yuan to catch vip fish (1 black carp with a vip label, priced at 1,200 yuan). they can also add 50 yuan to the 600 yuan to catch a "lucky marked" fish (the base price of this fish is 5,000 yuan). if anglers catch a "marked fish", they can exchange it for the equivalent in rmb according to the number on the "marked fish". if they catch a "lucky marked" fish, they can get rmb equivalent to the base price and the increased amount. if they do not catch a "lucky marked" fish, the price of the fish will be accumulated.from april 2022 to august 2023, a total of 292 people went to the fishing park to catch "standard fish", and the total entrance fees were 782,800 yuan.

the yicheng city procuratorate believes that the criminal suspect xu xiaohang opened a casino and organized 292 people to gamble, with a total gambling amount of 782,800 yuan. the circumstances are serious. his behavior violated article 303, paragraph 2 of the criminal law of the people's republic of china. according to article 176, paragraph 1 of the criminal procedure law of the people's republic of china, he should be held criminally responsible for opening a casino.
