recently, the reporter learned from the fengtai procuratorate that the procuratorate has urged administrative authorities to perform their duties in accordance with the law through consultations and issuing pre-trial prosecutorial recommendations for public interest litigation, and guided designated institutions for rehabilitation services for disabled children to complete problem rectification and improve the quality and level of rehabilitation services.
when handling cases involving minors, the fengtai procuratorate found that many minor victims who needed psychological counseling and rehabilitation treatment were seeking rehabilitation institutions for treatment on their own. prosecutors used the independently developed legal supervision model for comprehensive judicial protection of children in difficult situations, searched for keywords and compared them in data such as the "12345 hotline" and the people's court judgment documents network, and deeply explored clues of infringement of the rights and interests of children in difficult situations, including children with disabilities. it was found that the four designated institutions for rehabilitation services for children with disabilities in the district had problems such as incomplete monitoring coverage, substandard teacher qualifications, and unqualified health care doctors.
on this basis, the fengtai procuratorate initiated an investigation into the issue of damage to the public interests of disabled children, and jointly with the district disabled persons' federation conducted on-site visits, reviewed files, and held individual interviews with designated rehabilitation institutions for children with intellectual disabilities, autism, and other mental and physical disabilities in fengtai district.
subsequently, the prosecutors handling the case consulted with the industry supervisory authorities and business guidance authorities on the issue of standardized management of designated institutions for the rehabilitation of disabled children, and used their public interest litigation functions to issue pre-trial public interest litigation prosecutorial recommendations to them.
after receiving the procuratorial suggestion, the relevant designated institutions replaced the business managers without teaching certificates and health care workers without health care medical certificates after being interviewed and urged to make corrections by the competent business authorities. they also handled the resignation, job adjustment or required the front-line rehabilitation teachers without rehabilitation certificates to obtain certificates, and added public area monitoring in some blind spots of monitoring. the competent industry authorities strengthened the supervision of private non-enterprise units from multiple angles and through multiple channels, such as social organization grade assessment and key spot checks and audits.
taking this case as an opportunity, the fengtai procuratorate innovated the form of legal education, and jointly with the district education commission unveiled the fengtai district "visit the procuratorate, get close to prosecutors" youth career experience base, and included the follow-up evaluation of rehabilitation institutions as one of the contents of the career experience activities. it led the school principals, psychological teachers and students to follow the prosecutors to visit designated rehabilitation service institutions to evaluate the rectification work of public interest litigation.
