Recently, the Shandong Provincial Market Supervision Bureau held a centralized review meeting of the Contract Format Clauses Review Committee, inviting experts from the National People's Congress, arbitration, universities, law firms and other fields to conduct a centralized review of typical clauses collected by the provincial market supervision departments in the special rectification of unfair contract format clauses in 2024. Guo Chaobo, member of the provincial bureau's party group and deputy director, attended the meeting and delivered a speech.
At the review meeting, all members of the review committee played to their professional strengths and reviewed the relevant clauses in the fields of real estate sales, car sales, education and training, decoration and renovation, express logistics, public utilities, tourism, wedding and matchmaking, property and other industries one by one.
The meeting pointed out that in recent years, the provincial market supervision system has actively fulfilled its statutory duties, taking the standardization of unfair contract format clauses and the formulation and promotion of contract model texts as the starting point, and has successively organized and carried out a series of special rectifications, effectively regulating the market order and promoting the expansion and improvement of the provincial contract model texts. The establishment and operation of the contract format clause review mechanism aims to make full use of the professional advantages of experts and scholars, provide professional opinions on laws, policies and other aspects for the review of contract format clauses, further improve the professionalization and standardization of the contract administrative supervision work of the market supervision department, and ensure the legal, standardized, scientific and fair performance of the contract administrative supervision responsibilities.
The meeting required that we should earnestly study and implement the spirit of the Third Plenary Session of the 20th CPC Central Committee, accurately grasp the new situation and new requirements, continuously improve the contract format clause review mechanism, promote the standardization and standardization of review work, and provide more powerful support for the performance of contract administrative supervision responsibilities. We should give full play to the integrated and systematic role of the contract format clause review mechanism, pool collective wisdom, form review opinions, guide the supervision of contract format clauses, continuously promote fairness and justice in consumer contracts, and effectively protect the legitimate rights and interests of consumers.
