the 11th meeting of the standing committee of the 14th national people's congress will be held in beijing from september 10 to 13. wang xiang introduced that in april 2024, the 9th meeting of the standing committee of the 14th national people's congress held its first review of the draft amendment to the statistics law. according to opinions from all parties, the draft amendment decision submitted to this standing committee meeting for review is proposed to make the following major revisions: first, it reflects the new development concept and stipulates that a scientific and reasonable statistical standard and statistical indicator system should be established based on the new situation of economic and social development. second, it strengthens the construction of statistical informatization, stipulates that the state promotes the deep integration of modern information technology and statistical work, requires statistical survey subjects to promote the electronicization and digitization of statistical ledgers, vigorously promotes the transformation and application of new technologies such as big data, cloud computing, and artificial intelligence in statistical work, and improves the quality of statistical data. third, it refines the statistical supervision regulations and includes the performance of statutory statistical duties in the content of statistical supervision. fourth, it strengthens the responsibility for preventing and controlling statistical fraud and falsification, adds provisions to include the prevention and punishment of statistical fraud and falsification in the scope of responsibility for administration according to law and performance of duties according to law, strengthens the assessment and management of the statistical work of leading cadres, and further strengthens the rigid constraints of the responsibility system for preventing and punishing fraud. fifth, strengthen the sharing of statistical information, stipulate that the statistical agencies and relevant departments of the people's governments at or above the county level shall establish and improve the statistical information sharing mechanism, clarify the scope, standards and procedures for sharing statistical information, improve the efficiency of government statistics, eliminate duplication and overlap in statistical surveys, reduce the burden of multiple reporting by statistical survey subjects, etc., and enhance its operability.

in recent years, statistical fraud and falsification have continued despite repeated prohibitions, seriously damaging the authenticity and accuracy of statistical data, and the public has reacted strongly to this. the paper noted that in terms of preventing and punishing statistical fraud, the draft amendment to the statistics law submitted for review this time intends to make targeted improvements.

"this is one of the outstanding problems that need to be solved urgently in statistical work." wang xiang introduced that in order to prevent and punish statistical fraud, the draft amendment mainly stipulates the establishment and improvement of relevant responsibility systems, and the increase of prohibited behaviors and corresponding legal responsibilities for relevant persons in charge. during the deliberation of the standing committee and the extensive solicitation of opinions from all parties, some members of the standing committee, relevant departments and localities suggested further strengthening the rigid institutional constraints for preventing and punishing statistical fraud and falsification, and clarifying relevant measures.

after research, the draft amendment decision is mainly proposed to make the following amendments: first, add provisions such as "include the prevention and punishment of statistical fraud and falsification in the scope of responsibility for administration according to law and performance of duties according to law" and "strengthen the assessment and management of statistical work of leading cadres". second, further expand the scope of prohibited behaviors of relevant responsible persons, and stipulate that "shall not explicitly or implicitly suggest lower-level units and their personnel or statistical survey subjects to fill in false data". at the same time, it stipulates that "shall not retaliate against units and individuals who perform their duties according to law or refuse or resist statistical violations". third, increase the penalties for the behavior of relevant responsible persons who fail to supervise the serious inaccuracy of statistical data; and add a bottom-line provision to ensure that the legal responsibility of various types of statistical fraud and falsification is fully investigated through the method of "listing and bottom-line".
